These Terms of Use and Consent Agreement ("Terms") govern your use of the DoctorConnect Patient Portal ("Portal"). Please read them carefully before using the Portal. By creating an account or using any Portal feature, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing, registering for, or using this Patient Portal, you confirm that you have read, understood, and agree to be bound by these Terms of Use and Consent Agreement and our Privacy Policy. If you do not agree to any part of these Terms, you may not use the Portal.
These Terms constitute a legally binding agreement between you ("you," "your," or "Patient") and Adtel International, Inc., doing business as DoctorConnect ("DoctorConnect," "we," "us," or "our"), as the technology provider that operates this Portal on behalf of your healthcare provider.
Your use of the Portal is voluntary. You are not required to use the Portal in order to receive healthcare services from your provider. If you choose not to accept these Terms, you may contact your healthcare provider's office directly for any services you need.
2. Who We Are — Understanding the Relationship
It is important that you understand the roles of the different parties involved in this Portal:
- DoctorConnect (Adtel International, Inc.) is the technology company that builds, hosts, and maintains this Patient Portal. We provide the software platform and technical infrastructure. We are not a healthcare provider and do not provide medical advice, diagnosis, or treatment.
- Your Healthcare Provider ("your Provider") is the physician practice, clinic, hospital, or other healthcare organization where you receive medical care. Your Provider has selected DoctorConnect as their patient portal platform. Your Provider controls which Portal features are available to you, what health information is displayed, and how your clinical data is managed.
- You are the patient (or the authorized representative of a patient) using this Portal to interact with your Provider.
DoctorConnect acts as a Business Associate of your healthcare Provider under the Health Insurance Portability and Accountability Act ("HIPAA"). This means we handle your health information only as directed by your Provider and in accordance with applicable law. Your Provider remains responsible for your medical care and for the clinical information made available through this Portal.
3. Eligibility
To use this Patient Portal, you must meet all of the following requirements:
- You must be a current or recent patient of a healthcare provider that uses DoctorConnect, or you must be the parent, legal guardian, or legally authorized representative of such a patient.
- You must be at least 18 years of age. If you are a parent or legal guardian, you may access the Portal on behalf of a minor child in your care, subject to applicable state law regarding minor consent and access to health records.
- You must have a valid mobile phone number or email address on file with your Provider for identity verification purposes.
- You must be able to successfully complete our two-factor authentication process to verify your identity.
If you are accessing this Portal on behalf of another person (such as an elderly parent or a minor child), you represent and warrant that you have the legal authority to do so and to agree to these Terms on their behalf. You are responsible for ensuring that your use of the Portal on behalf of another person complies with all applicable laws.
4. Portal Services
The Patient Portal may provide access to some or all of the following services, depending on which features your Provider has enabled:
- Appointment Management — View upcoming and past appointments, confirm or cancel appointments, and request appointment changes or new appointments. Appointment requests are subject to your Provider's availability and approval.
- Health Records — View lab results, medications, diagnoses, and other clinical information that your Provider makes available through the Portal.
- Secure Messaging — Send and receive non-urgent messages with your Provider's office through an encrypted messaging system within the Portal.
- Patient Intake Forms — Complete new patient registration forms, medical history questionnaires, consent documents, and other paperwork electronically before your visit.
- Surveys — Complete patient satisfaction surveys and other questionnaires as requested by your Provider.
- Document and Photo Uploads — Upload photographs of insurance cards, driver's licenses, and other documents requested by your Provider.
- Payments — View account balances and make payments for copays, outstanding balances, and other charges using a credit or debit card.
Not all features may be available at all times or for all patients. Your Provider controls which features are enabled. Features may be added, modified, or removed at any time.
5. Account Security — Your Responsibilities
Protecting your Portal account is a shared responsibility. You are responsible for the following:
- Keep your credentials private. Do not share your login information, verification codes, or access links with anyone, even family members. If a family member needs Portal access, they should set up their own account or request authorized proxy access through your Provider.
- Use secure devices. Only access the Portal from devices that you trust. Avoid logging in on public or shared computers (such as at a library or hotel). If you must use a shared device, always log out completely when finished.
- Protect your email and phone. Because we use your email address and phone number for two-factor authentication and communications, you must keep these accounts secure. If your phone is lost or stolen, or if your email account is compromised, notify your Provider's office promptly.
- Report unauthorized access immediately. If you believe someone has accessed your Portal account without your permission, or if you notice any activity you did not authorize, contact your Provider's office right away.
- Keep your contact information current. It is your responsibility to ensure that the phone number and email address on file with your Provider are accurate and up to date. Outdated contact information may prevent you from accessing the Portal or receiving important communications.
We implement industry-standard security measures including encryption, secure data storage, session timeouts, and two-factor authentication to protect your account. However, no technology system is completely immune to security threats. You acknowledge that you use the Portal at your own risk and that we cannot guarantee absolute security.
6. Two-Factor Authentication & Verification Consent
To protect your health information, the Portal requires two-factor authentication ("2FA") each time you log in. This means that in addition to entering your login credentials, you will need to enter a one-time verification code sent to your mobile phone (via SMS text message) or email address.
By using the Portal, you consent to the following:
- Receiving verification codes. You consent to receive automated SMS text messages and/or emails containing one-time verification codes at the phone number and email address you have provided to your Provider. Standard text messaging rates from your wireless carrier may apply.
- Purpose of codes. These codes are used solely for the purpose of verifying your identity when logging into the Portal. We will not use this consent to send you marketing messages.
- Code expiration. Verification codes are valid for a limited time. If your code expires, you may request a new one through the login screen.
- Your responsibility. You must not share verification codes with anyone. A verification code is proof of your identity. Anyone who has your login credentials and a valid verification code can access your health information.
7. HIPAA Compliance & Privacy Acknowledgment
Your health information is protected by federal and state privacy laws, including the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and the Health Information Technology for Economic and Clinical Health Act ("HITECH Act").
What you should know:
- Your Provider is the Covered Entity. Under HIPAA, your healthcare Provider is the "Covered Entity" that is primarily responsible for protecting your health information and providing you with a Notice of Privacy Practices. If you have questions about how your health information is used and disclosed, please contact your Provider's office or review their Notice of Privacy Practices.
- DoctorConnect is a Business Associate. DoctorConnect has entered into a Business Associate Agreement ("BAA") with your Provider. This means we are legally required to protect your health information, use it only as permitted by the BAA and applicable law, and report any security breaches as required by law.
- How we protect your data. All health information transmitted through the Portal is encrypted both in transit (while being sent over the internet) and at rest (while stored on our servers). We use Microsoft Azure cloud infrastructure, which maintains HIPAA compliance certifications, to store your data securely.
- Your rights. Under HIPAA, you have the right to access your health information, request corrections, request restrictions on certain uses, receive an accounting of disclosures, and file a complaint if you believe your privacy rights have been violated. To exercise these rights, contact your Provider directly.
- Minimum necessary standard. We access and use only the minimum amount of your health information that is necessary to operate and maintain the Portal on behalf of your Provider.

8. Consent to Electronic Communications
By using the Portal, you consent to communicate with your Provider and with DoctorConnect electronically. This includes:
8.1 Secure Messaging
- The Portal's secure messaging feature allows you to send and receive non-urgent messages with your Provider's office. These messages are encrypted and transmitted through the Portal's secure system.
- Messages are not monitored around the clock. Your Provider's staff typically reviews and responds to messages during normal business hours. Response times vary. Do not use secure messaging for urgent or time-sensitive medical matters.
- Messages sent through the Portal may become part of your medical record at your Provider's discretion.
- You understand that electronic communication, while encrypted, carries inherent risks that do not exist with in-person communication, including the possibility of technical failures, delays in delivery, or misdirected messages.
8.2 Notifications and Reminders
- You may receive appointment reminders, Portal notifications, and other communications via email, SMS text message, or push notification at the contact information you have provided.
- While we take steps to limit the health information included in notifications, there is a possibility that notification previews could be visible on your device's lock screen or in your email inbox. You are responsible for configuring your device's notification settings to your desired level of privacy.
- You may opt out of certain non-essential notifications by adjusting your preferences within the Portal or by contacting your Provider's office. However, you may not opt out of security-related communications (such as two-factor authentication codes) while maintaining Portal access.
8.3 Electronic Signatures and Consent
- By using the Portal to complete forms, confirm appointments, authorize payments, or submit other information, you agree that your electronic actions (such as clicking "I Agree," "Submit," "Confirm," or similar buttons) constitute your electronic signature and are legally binding to the same extent as a handwritten signature.
- This consent to electronic transactions is provided in accordance with the federal Electronic Signatures in Global and National Commerce Act ("E-SIGN Act") and applicable state electronic signature laws.
9. Document and Photo Uploads
The Portal may allow you to upload photographs and digital copies of documents, including but not limited to:
- Insurance cards (front and back)
- Government-issued photo identification (such as a driver's license or state ID)
- Referral letters or prior authorization documents
- Other documents requested by your Provider
By uploading documents or photos through the Portal, you acknowledge and agree to the following:
- Consent to upload. You consent to the electronic transmission and storage of the documents and photos you upload. Uploaded files are encrypted during transmission and stored securely on Microsoft Azure cloud servers that comply with HIPAA security requirements.
- Accuracy and authenticity. You represent and warrant that all documents and photos you upload are authentic, accurate, and belong to you (or to the patient on whose behalf you are authorized to act). Uploading fraudulent, forged, or misrepresented documents is prohibited and may result in termination of your Portal access and referral to appropriate authorities.
- Sensitive personal information. You understand that the documents you upload may contain sensitive personal information such as your full name, date of birth, address, Social Security Number (if visible on certain documents), insurance member ID, and photograph. You accept the risk inherent in transmitting such information electronically.
- Retention and deletion. Uploaded documents are retained in accordance with your Provider's document retention policies and applicable law. DoctorConnect stores these documents on behalf of your Provider and will delete them when directed to do so by your Provider or as required by our data retention policies.
- File requirements. You are responsible for ensuring that uploaded files are clear, legible, and in an accepted format (typically JPEG, PNG, or PDF). Illegible or corrupt files may delay the processing of your information.
10. Patient Intake Forms & Surveys
The Portal may allow you to complete intake forms, medical history questionnaires, consent documents, and patient satisfaction surveys electronically.
- Completeness and honesty. You agree to provide complete and truthful information on all forms and questionnaires. Providing inaccurate or incomplete information may affect the quality of your medical care.
- Electronic submission. When you submit a form or survey through the Portal, your responses are transmitted electronically to your Provider. Submitted forms may become part of your permanent medical record.
- Surveys are voluntary. Patient satisfaction surveys and similar questionnaires are voluntary. Your decision to complete or decline a survey will not affect your medical care or your access to the Portal.
- De-identified survey data. Responses to patient satisfaction surveys may be used by your Provider and by DoctorConnect in aggregate, de-identified form (meaning your name and identifying information are removed) for quality improvement and analytics purposes.
11. Payments & Payment Authorization
The Portal may allow you to view your account balance and make payments for copays, outstanding balances, and other charges from your Provider.
11.1 Payment Processing
- Payments made through the Portal are processed by a third-party payment gateway (currently Converge, operated by Elavon / U.S. Bank). DoctorConnect does not directly process, store, or have access to your full credit or debit card numbers.
- All payment transactions are encrypted and processed in compliance with the Payment Card Industry Data Security Standard ("PCI DSS").
- By entering your payment information and clicking "Submit Payment" (or similar button), you authorize the charge to the credit or debit card you have provided in the amount displayed on the payment screen.
11.2 Your Payment Responsibilities
- You are responsible for verifying the payment amount before submitting your payment. Review the amount carefully. Payments submitted through the Portal are processed immediately and may not be reversible.
- If you believe a payment was made in error, or if you have a billing dispute, contact your Provider's billing office directly. DoctorConnect does not manage billing disputes or issue refunds; your Provider is responsible for all billing matters.
- DoctorConnect is not responsible for any fees, penalties, or charges imposed by your bank or card issuer in connection with payments made through the Portal (such as overdraft fees or foreign transaction fees).
11.3 Payment Receipts
- A confirmation screen and/or email receipt will be provided after each successful payment. You are responsible for keeping your own payment records. We recommend saving or printing your confirmation for your records.
12. Health Information Disclaimer
- Health information displayed in the Portal (including lab results, medications, diagnoses, and visit summaries) is provided by your Provider's electronic health record system. DoctorConnect displays this information as a technology service but does not independently verify, interpret, or guarantee its accuracy or completeness.
- Lab results and other clinical data shown in the Portal are for informational purposes only. Normal reference ranges may vary by laboratory. Always consult your Provider for the interpretation of lab results and for medical advice before making any healthcare decisions.
- The Portal may not contain your complete medical record. Your Provider determines which information to make available through the Portal.
- There may be a delay between when your Provider enters information into their system and when it appears in the Portal. Do not rely on the Portal for the most current information about your care.
13. Not for Emergencies
- The Portal is not designed, intended, or equipped to handle medical emergencies or urgent health situations.
- Secure messages sent through the Portal are not monitored in real time. There may be significant delays before your message is read and responded to, especially outside of business hours, on weekends, and on holidays.
- If you are experiencing symptoms that you believe require immediate medical attention — such as chest pain, difficulty breathing, severe bleeding, signs of a stroke, allergic reactions, or thoughts of self-harm — call 911, go to the nearest emergency room, or call the 988 Suicide & Crisis Lifeline (call or text 988).
- DoctorConnect and your Provider shall not be held liable for any harm, injury, or adverse outcome resulting from your use of the Portal to communicate about an emergency or urgent medical situation instead of calling 911 or seeking immediate in-person care.
14. Data Accuracy — Your Responsibility
You are responsible for ensuring that the information you provide through the Portal is accurate, complete, and up to date. This includes:
- Personal and contact information — your name, date of birth, address, phone number, and email address
- Insurance information — your insurance carrier, member ID, group number, and uploaded insurance card images
- Medical history — information provided on intake forms, including current medications, allergies, past surgeries, and family medical history
- Payment information — credit or debit card details entered for payment
Inaccurate or incomplete information may result in billing errors, insurance claim denials, delays in your care, or other adverse consequences. DoctorConnect and your Provider are not responsible for any problems caused by inaccurate information that you provide.
If you notice that information displayed in the Portal is incorrect (for example, an error in your medications, allergies, or contact information), please contact your Provider's office promptly to request a correction.
15. Acceptable Use Policy
When using the Patient Portal, you agree not to:
- Access or attempt to access another person's health information or Portal account without proper legal authorization
- Use the Portal for any unlawful purpose or in violation of any applicable local, state, or federal law
- Provide false, misleading, or fraudulent information through the Portal
- Use the Portal's messaging feature for emergencies or urgent medical situations (call 911 instead)
- Send abusive, threatening, harassing, or inappropriate messages through the Portal
- Attempt to probe, scan, or test the vulnerability of the Portal or attempt to circumvent any security measures
- Transmit viruses, malware, spyware, or any other malicious or harmful code through the Portal
- Use automated tools, bots, scrapers, or crawlers to access, extract data from, or interact with the Portal
- Interfere with or disrupt the Portal's operation, or the servers, networks, or infrastructure connected to it
- Reproduce, copy, sell, resell, or exploit any portion of the Portal without our express written permission
- Use the Portal for commercial purposes, advertising, or solicitation
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your Portal access, and may be reported to law enforcement if applicable.
16. Intellectual Property
All content, design, graphics, user interface, software, source code, and technology that make up the Patient Portal are the property of Adtel International, Inc. (DoctorConnect) or its licensors and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Patient Portal solely for your personal, non-commercial healthcare management purposes. You may not:
- Copy, modify, distribute, or create derivative works based on the Portal or its content
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Portal
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed on the Portal
- Mirror, frame, or embed any portion of the Portal on another website, application, or service
Your health information displayed in the Portal belongs to you and your Provider, not to DoctorConnect. Nothing in these Terms transfers ownership of your health information to DoctorConnect.
17. Third-Party Services
The Patient Portal may integrate with or rely upon third-party services to provide its functionality. These include, but are not limited to:
- Microsoft Azure — Cloud hosting and secure data storage infrastructure
- Converge / Elavon (U.S. Bank) — Payment gateway for processing credit and debit card transactions
- Google reCAPTCHA — Bot protection during login (subject to Google's Privacy Policy and Terms of Service)
- SMS/Email Delivery Providers — For sending verification codes, appointment reminders, and other communications
- Your Provider's EHR System — The electronic health record system used by your Provider to manage your clinical data
DoctorConnect is not responsible for the availability, accuracy, content, privacy practices, or security of any third-party services. Your use of third-party services may be subject to additional terms and conditions imposed by those providers. We encourage you to review the terms and privacy policies of any third-party services you interact with through the Portal.
18. Service Availability
We strive to maintain the Portal's availability, but we do not guarantee uninterrupted, error-free, or secure access to the Portal at all times. The Portal may be temporarily unavailable due to:
- Scheduled maintenance, updates, or upgrades
- Unscheduled system outages, hardware failures, software errors, or network problems
- Interruptions to third-party services that the Portal depends upon (such as cloud hosting or payment processing)
- Force majeure events, including but not limited to natural disasters, pandemics, acts of terrorism, power failures, government actions, or labor disputes
- Your Provider discontinuing, suspending, or changing their DoctorConnect services
We reserve the right to modify, suspend, or discontinue any part of the Portal at any time, with or without prior notice. We will make reasonable efforts to provide advance notice of planned maintenance or significant changes, but we are not obligated to do so.
19. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Patient Portal is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment.
- Neither DoctorConnect nor your Provider warrants that the Portal will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- DoctorConnect shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of data, loss of profits, loss of goodwill, personal injury, emotional distress, or business interruption, however caused and under any theory of liability (including negligence), even if DoctorConnect has been advised of the possibility of such damages.
- DoctorConnect shall not be liable for any damages or adverse outcomes arising from: (a) the display of inaccurate, incomplete, or delayed health information provided by your Provider's electronic health record system; (b) your reliance on information displayed in the Portal without consulting your Provider; (c) delays in message delivery or response; (d) unauthorized access to your account caused by your failure to safeguard your credentials; or (e) errors, omissions, interruptions, or deletions in the operation of the Portal.
- Total liability cap. In no event shall DoctorConnect's total cumulative liability to you for all claims arising out of or related to your use of the Portal exceed one hundred U.S. dollars ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
Your Provider's Liability. These Terms govern your relationship with DoctorConnect as the technology provider. Nothing in these Terms limits or waives any rights you may have against your healthcare Provider under applicable medical malpractice, consumer protection, or other laws. Questions about your Provider's liability should be directed to your Provider.
20. Indemnification
You agree to indemnify, defend, and hold harmless DoctorConnect (Adtel International, Inc.), its officers, directors, employees, contractors, and agents, as well as your healthcare Provider and their staff, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of or inability to use the Patient Portal
- Your violation of these Terms or any applicable law or regulation
- Your provision of inaccurate, false, or misleading information through the Portal
- Any unauthorized use of your Portal account, whether or not authorized by you
- Your infringement of any third party's rights, including intellectual property rights or privacy rights
21. Termination
Your access to the Patient Portal may be terminated under the following circumstances:
- By you: You may stop using the Portal at any time. To formally close your Portal access and request deletion of your Portal account data, contact your Provider's office.
- By your Provider: Your Provider may terminate or suspend your Portal access if you are no longer a patient, if your Provider discontinues use of DoctorConnect, or for any other reason at your Provider's discretion.
- By DoctorConnect: We may suspend or terminate your Portal access immediately, without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or pose a security risk to the Portal or its users.
Upon termination, your right to access the Portal ceases immediately. Termination does not affect your Provider's obligation to maintain your medical records in accordance with applicable law. The following sections of these Terms survive termination: Intellectual Property (Section 16), Limitation of Liability (Section 19), Indemnification (Section 20), Governing Law (Section 22), and General Provisions (Section 24).
22. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. To the extent not preempted by federal law (including HIPAA), all disputes arising from these Terms or your use of the Portal shall be subject to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.
Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting DoctorConnect at the address provided in Section 25. We will attempt to resolve any dispute in good faith within thirty (30) days of receiving your written notice.
You agree that any cause of action or claim arising from your use of the Portal must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred.
23. Changes to These Terms
We reserve the right to modify, amend, or replace these Terms at any time. When we make changes:
- We will update the "Effective" and "Last Updated" dates at the top of this page.
- For material changes (changes that significantly affect your rights or obligations), we will make reasonable efforts to notify you through the Portal, by email, or by other means before the changes take effect.
- Your continued use of the Patient Portal after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Portal.
We encourage you to review these Terms periodically. It is your responsibility to check for updates.
24. General Provisions
- Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
- Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DoctorConnect regarding your use of the Patient Portal. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and DoctorConnect regarding the Portal.
- Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any provision shall be effective only if made in writing and signed by an authorized representative of DoctorConnect.
- Assignment. You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. DoctorConnect may assign these Terms in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.
- No Third-Party Beneficiaries. These Terms are intended solely for the benefit of you and DoctorConnect. Nothing in these Terms shall create any third-party beneficiary rights, except that your healthcare Provider is an intended third-party beneficiary of the limitation of liability and indemnification provisions.
- Headings. The section headings in these Terms are for convenience only and have no legal or contractual significance.
- Accessibility. We are committed to making the Patient Portal accessible to all users. If you experience any difficulty accessing or using the Portal due to a disability, please contact us so we can work to accommodate your needs.
